I'm not aware of Xcode 2.0 being officially released separately from 
Tiger, but that seems to be what you're implying. That doesn't make 
sense anyway, because I've be quite surprised if Xcode 2.0 didn't 
require Tiger to run.

By "out there" do you mean the accidental week-early release of Tiger 
by PCMall and ClubMac? If that's so, then the NDA still applies, 
because it says it ends once material is made available to the public 
*by apple*, which isn't what happened in this case.

Anyway, this is a reasonably pointless argument.
